BYLAWS OF THE NEW ZEALAND POOL ASSOCIATION

 

 

 

 

AS AT 01st JANUARY 2009

 

 

 


 

 

 

 

1.              Membership:

 

There are currently two types of affiliated membership to the NZPA, they are Regional Associations and Partial Associations.  Both types of membership require the Associations to be Incorporated and Financial.

1.1.     An affiliated Regional Association member of the NZPA is defined by the geographical region in which that Association is based and will hold the membership of all members within that region.  An affiliated Regional Association has full rights as a member of the NZPA, entitled to voting rights at General Meetings.  All players must be members of a recognised Regional Association to allow them full rights and privileges of the belonging to the NZPA, e.g. to participate in NZPA Ranking Tournaments.  Individuals may choose to be a member of more than one Regional Association.

          The NZPA Executive has set the geographical regions to be known as Regional Associations.  A list of Regional Associations is available from the NZPA Secretary. 

1.2.         An affiliated Partial Association member of the NZPA is defined by being within a geographical region that already has an existing affiliated Regional Association.  An affiliated Partial Association has limited rights as a member of the NZPA, and is not entitled to voting rights at General Meetings.  If a Partial Association has individual members, those members will also need to be members of a recognised Regional Association to allow them full rights and privileges of belonging to the NZPA.

1.3.         All affiliate members, both Regional and Partial must abide by the Constitution and Bylaws of the NZPA.  Each association is responsible for advising their individual members of their rights and obligations whilst being affiliated with the NZPA.  Members participating in International events must also be made aware of the Oceania Pocket Billiards Association (OPBA) Conditions of Entry and Tournament Guidelines.

 

2.              Fees:

 

2.1.         Membership Subscriptions:

          This is the subscription set for affiliated Regional Associations and affiliated Partial Associations, currently (i.e. for 2008) these are $250.00.

2.2.         Ranking Fees:

          This is the annual fee, charged at the end of each tournament calendar year, set for individual members to enter the NZPA Ranking lists in both 8-Ball and 9-Ball.  All individual members playing in NZPA ranking tournaments must pay this fee.  Currently (i.e. for 2008) this fee is $10.00 for each discipline.

          The responsibility for payment of this fee lies with the individual members Regional Association that the individual member is representing.  These fees are to be forwarded to the NZPA Treasurer within 28 days of the date of the invoice.  These fees go towards the administrative costs of the NZPA.

2.3.         Player Levies:

          These are the fees charged to players entering any NZPA Ranking tournament and are part of the entry fee charged by the host Association.

2.3.1.    Currently (i.e. for 2008) the NZPA portion of these fees are $10.00 for Regional Events and are $20.00 for National Events and $20 for Men, $10 for Ladies for Island.  These fees are to be forwarded to the NZPA Treasurer within 14 days of the Tournaments conclusion by the host Association.  Half of these fees collected are placed into a separate Players account to assist with costs associated with players representing New Zealand.  The other half of these fees go towards administrative costs of the NZPA.

2.3.2.         Currently (i.e. for 2008) the Oceania portion of these fees are $10.00 for the National 8 and 9 Ball events and $20.00 for the Trans Tasman 9-Ball and Oceania Events.  These fees are also to be forwarded to the NZPA Treasurer within 14 days of the Tournaments conclusion by the host Association.  The Treasurer will then forward these fees to the OPBA.

2.4.         National 9-Ball Tournament Levy:

          This levy is charged to the Association hosting this particular Tournament and is to be paid no later than 3 months prior to the date of the commencement of the tournament.  The NZPA executive reserves the right to waive this fee upon application from the Association wishing to host the tournament.  Currently (i.e. for 2009) this levy is $5,000.00.  This money is used by the NZPA to assist in sending the Men’s winner (note that if a unranked player wins this event, they may not be eligible for the spot, in the event of this occurring contact the Committee for clarification) to the World 9 Ball Championships and does not make up part of the prize pool.

 

 

 

 

 

 

 

 

 

2.5.         Penalties:

2.5.1.         If membership subscriptions remain unpaid after three months from date of invoice, Rule eight (8) of the NZPA constitution shall apply.

2.5.2.         With the exception of membership subscriptions, failure to meet the listed requirements will result in the Association being charged a 10% penalty on the amount owing.  And 10% compounding penalty on the outstanding amount every following month from the date of the first penalty, until the amount is paid in full.

2.5.3.         With the exception of membership subscriptions, if the listed requirements remain unpaid by two months after the event, the Association and their members lose all privileges of membership until the total debt is cleared.

2.5.4.         With the exception of membership subscriptions, if the listed requirements remain unpaid by three months after the event, the outstanding amount will be passed to a collection agency for collection.  All costs associated with collection of the outstanding amount, including any collection agency fees, will be payable by the member Association.

2.6.         Tournament Entry Fees: (Including levies)

2.6.1.         All Oceania events Entry fees are $120.00

2.6.2.         National 9 Ball Champs Entry fee is Men $110.00; Ladies $80

2.6.3.         National 8 Ball Champs entry fee is Men $110.00; Ladies $80

2.6.4.         Island 8 and 9 Ball Champs entry fees are Men $70.00; Ladies $50

2.6.5.         Regional 8 and 9 Ball Champs entry fees are to be no more than $50.00, we encourage a lesser amount for the Ladies entries

2.6.6.         Junior 8 and 9 Ball National Champs entry fees are $30.00

2.6.7.         All other Junior entry fees are to be no more than $20.00

 

3.              Events Calendar:

 

Each year, the NZPA Executive in conjunction with the OPBA and the NZCBS are responsible for scheduling their events for the forthcoming year.  Associations are asked to submit requests to host Events prior to 1st October (or any date the Executive sets to fit in with an Executive meeting) to allow a calendar to be available by 31st January.

3.1.     Oceania Ranking Tournaments will be held at the dates set by the OPBA Executive.

3.2.     All Tournaments must be held before 1st December for ranking points to be counted.

3.3.     The NZPA AGM will be held the day prior to the commencement of the National 8-Ball Championships.

 

4.              New Zealand Team Selection:

 

Each year, the NZPA select a team and team manager to represent New Zealand in a Trans Tasman Test.  This test alternates between Australia and New Zealand.  The team for this event currently consists of 6 Men and 6 Ladies.  This team is announced on 1st December each year.  Members are selected as follows:

4.1.         The Winners of the National 8 Ball Champs*.

4.2.         The Winners of the National 9 Ball Champs*.

4.3.         The highest ranked player available on the 9 Ball ranking list at completion of the 9 Ball season.

4.4.         The highest ranked player available on the 8 Ball ranking list at completion of the 8 Ball season.

4.5.         Two Men and two Ladies as selected by the NZPA Executive.

4.6.         Test Team Manager as selected by the NZPA Executive.

*Note: any unranked player that enters and wins the 8 or 9-Ball Champs is not an automatic selection and it will be at the committees discretion.

Players that are selected must continue to be members of the NZPA for the year they are selected to play in or forfeit their position.

The NZPA reserve the right to exclude a player whose performance places them into the team as per the above selection criteria, but whose behaviour is not deemed as suitable for a player representing their country.  Selected Players must also commit to the contract as stipulated by the NZPA.  The contract will specify items of their uniform that they will need to provide, promotional attendance requirements, team meetings & practice sessions, behavioural requirements, etc.

 

5.              Representatives:

 

Any player representing New Zealand or Oceania in any cue sport who is overseas and unable to attend an NZPA ranking tournament will receive ranking points based on their average from the previous three ranking events.

 

 

 

 

Note any unranked player that wins an event that attracts a representative spot to an International Event may not be eligible for selection.

 

6.              Prizes:

 

6.1.         At National and Island events, all those who qualify into the top 25% of the field should be entitled to at least the value of their entry fee back. (E.g. Last 16 in field sized 64).

6.2.         In all Tournaments at least 80% of all entry fee money, not including levies, must be paid out in prizes.

6.3.         If plate or flyte events are held in conjunction with a Tournament, (and this is recommended by the NZPA), then no entry fee money from the main event may be used for prizes in these events.

 

7.              Tables & Playing Conditions:

 

7.1.         All tables should be of the highest playing quality available.  Provision should be made to have practice tables available for competitors at the venue wherever possible.

7.2.         For National and Island events; the tables, cloth & 2 ¼” balls must conform to the standards of the World Pool-Billiard Association (WPA).

7.3.         All NZPA Ranking Tournaments are to be played using current WPA World-Standardised Rules.

7.4.         All NZPA Ranking Tournaments are to be smoke and alcohol free. 

          Tournament officials must be notified immediately if any player is found smoking or drinking alcohol whilst playing a match, this includes between frames.  Any breach of this rule will result in the following:

7.4.1.         Offending player will receive one official reminder to the rules.

7.4.2.         If the behaviour continues then the player will forfeit the current match.

7.4.3.         The third breach will result in the player being disqualified from the tournament.

 

8.              Entry Forms & Posters:

 

8.1.         Entry Forms & Posters:

          For National & Island events, entry forms and posters must be sent to all Associations at least three months prior to closing date for the event.   

          It is recommended that the entry form allows room for a team manager to be named, this would improve communication with queries and any disciplinary issues that may arise during the tournament.

8.2.         Closing Dates:

          Entries for National and Island events should close two weeks prior to the date of the tournament.

          Closing dates must be adhered to as advertised by the poster.

8.3.         Poster Details:

          Posters for Tournaments should include the following information:

8.3.1.         Event Name.

8.3.2.         Date of the Event.

8.3.3.         Hosting Association.

8.3.4.         Venue name(s) and location(s).

8.3.5.         Entry Fee (including any NZPA and OPBA levies as stated).

8.3.6.         Entry Closing Date.

8.3.7.         Field limitations (if any).

8.3.8.         Address for receipt of entry forms and money.

8.4.     Jump Shots:

          The decision on whether or not to allow jump shots in a tournament is up to the hosting Association.  If jump shots are going to be disallowed, this must be notified on the tournament poster.

 

9.              Entrants:

 

9.1.         All entrants must be registered financial members of a financial affiliated Regional Association.

9.2.         All individual member entry fees must be received through the individual members Regional Association.

9.3.         For National events, only New Zealand citizens and entrants who have been granted New Zealand permanent residency by the New Zealand Immigration Department may enter.

9.4.         Players may only participate in Island events for one Island, per discipline, of which they are a financial member of a Regional Association in that particular Island.

9.5.         Players may only participate in Regional events for one region, per discipline, of which they are a financial member.

9.6.         It is the responsibility of the individual members Regional Association to ensure that entrants meet all necessary criteria prior to accepting and or forwarding their entry to a hosting Association.



9.7.         Players may participate in as many Tournaments as they like, however the Ranking lists will only include a maximum of their best four results.

 

10.           Tournament Draws:

 

For National and Island events, the proposed draw, format, playing times and prize money, once completed by the hosting Association, is required to be sent to the NZPA Registrar within five days of the entry closing date. 

After final approval of the proposed draw etc. has been given by the Registrar, the hosting Association should advise all other Associations of the draw and playing times within one week of the entry closing date for the event.

The Associations should also be advised at this time of any official opening ceremony and scheduled players meetings.

Tournament Programs should be made available to players at commencement of the Tournament.

10.1.      Field Sizes:

          Field size in these events is limited to a maximum of 128 players in the Men’s events and 64 players in the Ladies events.  This is to ensure play is completed within the required time frame and the prestige of these events is maintained.

          Should the field size be limited to less than the number of entrants, then players shall be selected as follows:

10.1.1.     First priority to the current Titleholders of the appropriate event (automatic entry).

10.1.2.     Second priority to the current Regional Championship winners of the appropriate event.

10.1.3.     The balance of the field is taken from the highest ranked entrants on the current appropriate NZPA ranking list at time of close of entries.

There is a minimum field size of eight (8) players for any National, or four (4) players for any Island Event for ranking points to be awarded.

There is no minimum field size applied to Regional Events.
Please refer to Appendix A for the table showing the allocation of Ranking Points.

10.2.      Section Play Draw:

10.2.1.     For the correct order of play in section play, refer to the current NZPA tournament master draw sheets.

10.2.2.     Ranked entrants will be positioned into the draw according to their position on the current ranking list. Evenly ranked entrants will have their position determined by lot.

10.2.3.     Unranked entrants will be positioned in the draw, after the ranked entrants, and their order determined by known ability and then by lot.

10.2.4.     When maximum fields are reached, reserves will be drawn first from the ranking list then listed in order when the draw is distributed.  Those not getting into the field upon completion of registrations for the event shall have their Entry fee reimbursed.

10.2.5.     Any player who notifies the tournament organisers of their unavailability prior to the start of play may be substituted from the reserve list, (no reserve list = no substitution).

10.2.6.     Any player who has not previously advised the tournament organisers of their unavailability and does not appear by their second match will be automatically defaulted (see WPA rule 1.7). No substitution is allowed.

10.3.      Post Section Draw:

10.3.1.     All post section play shall be at the same venue.

10.3.2.     The four qualifiers from each section are decided using the following criteria in order:

10.3.2.1.          Most number of wins.

10.3.2.2.          Highest frame differential.

10.3.2.3.          Highest number of frames won.

10.3.2.4.          Who beat whom.

Note:  That the First and Second qualifier from each section will receive bonus ranking points, refer Appendix A.

10.3.3.     All qualifiers from each section are then listed in order using the same criteria as 8.3.2. and then entered into the draw. I.e. if there are 32 qualifiers, then the #1 ranked player will play the #32 ranked player & the #2 ranked player will play the #31 ranked player and so on.

10.3.4.     If the sections have uneven numbers of players participating then prior to listing all qualifiers in order, the following calculation is to be used and applied: A / B x C = D.

Where:       A = Number of participants in the common section size.

                 B = Number of participants in the section you are calculating.

                 C = Individuals total number of wins.

                 D = New total win number for that individual, to be used in calculating overall ranking. 





10.3.5.     The finals of the Men’s and Ladies events should be played at separate times to allow spectators the opportunity to watch both matches.  It is preferable that the Ladies final precedes the Men’s final.

 

 

11.           Results:

 

Tournament results are to be forwarded no later than seven days following the Event to the NZPA Registrar.  These results should also include a list of incidents that may need to be addressed by the NZPA Exec.  E.g. non-appearance of entrants, or players leaving the tournament early.  Results should also be forwarded to the media as soon as possible after they are known.

 

 

12.           NZPA Dress Code:

 

Any player arriving at a Tournament dressed inappropriately will be unable to play unless they are able to change in time for their match.  Listed below are minimum requirements and banned items.

12.1. Men:

Dress Trousers                                      (no cords, jeans or tracksuit-type pants)

Collared shirt                                        (no worn/untidy polo shirts or t shirts)

Formal leather dress shoes                 (no sport-type running shoes, jandals or sandals)

Tie or Bow Tie                      (optional)

12.2.  Ladies:

Dress trousers or Dress Skirt               (no cords, jeans or tracksuit-type pants, no mini skirts)

Blouse, Dress or Collared shirt           (no T-shirts or worn/untidy polo shirts)

Formal leather dress shoes                 (no sport-type running shoes or jandals)

12.3.  Juniors:

Clean, tidy Trousers or Skirt    

Blouse, Dress or Collared shirt           (no T-shirts or worn/untidy polo shirts)

Clean, tidy shoes                                  (no jandals or sandals)

Tie or Bow Tie                      (optional)

12.4.           No headphones or audio sets to be worn during play.

12.5.           No non-prescription glasses eg; sun glasses to be worn during play.

12.6.           Trousers/skirts must be secured (belted) at the waist, there must be no skin or undergarments showing whilst playing.

12.7.           No hoodies, thermals or other layers are to be showing, ie; no wearing a t shirt hanging out below a playing shirt

 

 

13.           Players Meeting & Official Opening:

 

It is recommended that these be held prior to the commencement of the players scheduled matches to advise them of the tournament regulations (including smoke and alcohol free playing conditions rule), introduce referees and other officials, advise of reserve substitutions and to answer any questions those attending may have.  This meeting should include player registration and attendance and notice must be sent with the original draw.

 

14.           Officials & Referees:

 

The host Association is responsible for the appointment and competence of all Officials, Referees and Head Referee for an event.  Any official or referee in the playing area must abide by the same NZPA playing conditions imposed on the players.

 

15.           Suspensions:

 

If any Regional Association suspends or bans any of its individual members, then that suspension or ban will also be deemed to be an automatic suspension or ban from the NZPA. 

The Regional Association must inform the NZPA Secretary immediately of any bans imposed on individual members.

The individual member may appeal the suspension or ban imposed by lodging a written appeal to the NZPA Secretary within 14 days of the suspension or ban.

Nothing in this rule shall affect any other powers of the NZPA.

16.           NZPA Disciplinary Committee

 

The Disciplinary Committee has the authority to hear and rule on charges of misconduct during NZPA National or Island events.  The Disciplinary Committee shall be made up of two members of the NZPA Executive Committee and one member of the hosting Association.

In the situation where an individual member has been cited for an alleged offence, that player will be given the opportunity to hear and defend the charge(s) in person and is able to have a support person present.

If any charge(s) of misconduct can not be heard by the Disciplinary Committee during the tournament, the charge(s) are to be passed to the Executive Committee to hear and rule on.

 

17.           NZPA Misconduct Penalties:

 

The penalties listed below are only guidelines, but there would be no lesser punishment than what is stated.  Penalties can be increased to suit the severity of crime/action. 

Any player or official who wishes to lay a complaint should do so, in writing, as soon as possible, but no later than seven days following the incident, to either their Team Manager, Tournament Control or an NZPA Executive Member.

The individual member being charged of an offence is required to be cited within fourteen days of the incident, stating time, place and details of the incident and possible penalties, in writing either personally or to the postal address for entries, otherwise the charge is not valid. 

The offender should then be advised when the case will be heard stating the time, place where the hearing is to take place so that he/she has the opportunity of reply to the charge(s) either in person or by letter, or organise representation and/or witnesses, etc. 

The complainant may attend the hearing but is not necessary. 

In the case of abuse, etc. the player must apologise in writing to the complainant concerned and to the hosting Regional Association, until those letters of apology are received the offender cannot take his/her place in any tournament, after serving sentence.

17.1.   Notification of withdrawal from Tournament after the draw has been completed. (Default form required)

          Penalty: Entry fee forfeited.

17.2.   Failure to notify of withdrawal from Tournament (unless exceptional circumstances exist).

          Penalties:

17.2.1.   Referred to NZPA Registrar.

17.2.2.   Entry fee forfeited.

17.2.3.   Ban from corresponding event the following year.

17.3.   Withdrawal from Tournament without reasonable excuse.

          Penalties:

17.3.1.   Referred to NZPA Registrar.

17.3.2.   Forfeit all points earned for that Tournament.

17.3.3.   Ban from corresponding event in the following year.

17.3.4.   Ban from next occurring NZPA 8 Ball and 9 Ball National events.

17.4.   Unreasonably disputing referee’s decision.

          Penalty: Referred to Disciplinary Committee by Tournament Controller or Official with a recommendation for at least a one-tournament ban.

17.5.   Publicly disputing referee’s decision and/or abuse, swearing, etc.

          Penalty: Referred to Disciplinary Committee by Tournament Controller or Official with a recommendation for a ban from the corresponding event in the following year and a ban from next occurring NZPA 8 Ball and 9 Ball National events.

17.6.   Abuse in public or private of any Official acting in official capacity at Tournament.

          Penalty: Same as 17.5.

17.7.   Striking an Official during Tournament.

          Penalty: Referred to Disciplinary Committee by Tournament Controller or Official with a recommendation for a minimum of a two-year ban.

17.8.   Bringing New Zealand and/or local Association into disrepute by actions of member(s) i.e. abusing venue Managers/publicans, damaging property, fighting, swearing, etc.

          Penalty: Same as 17.7.

17.9.   Any use of illegal substances/drugs will result in an immediate minimum two-year ban.
